What Is Title IX?

Title IX of the Education Amendments Act of 1972 prohibits sex-based discrimination in educational programs and activities that receive federal funding. Colleges and universities that receive federal funding are required to investigate and address certain allegations of sexual harassment and sexual misconduct.

Most institutions, including Georgetown College, maintain a dedicated Title IX office responsible for receiving complaints, conducting investigations, and overseeing the grievance process.

Title IX Policy at Georgetown College

Georgetown College outlines its current policies in their student handbook, under a section called Title IX Prohibited Conduct and Sexual Misconduct Policy. This details the College’s approach to addressing sexual harassment and misconduct, as well as the definitions and classifications of prohibited behaviors under Title IX.

The policy is divided into two main sections: Section I, which pertains to Title IX Prohibited Conduct, including sex-based discrimination, sexual harassment, and retaliation; and Section II, which covers other forms of sexual misconduct not governed by Title IX but still prohibited by the College. The policy applies to all members of the Georgetown College community, including college students.

Initial Complaint and Formal Process

When a complaint is filed against a student at Georgetown College, the school can initiate a formal investigation/disciplinary process to determine whether a student violated college rules and, if so, what sanctions should apply.

If the conduct alleged in the complaint would not constitute Section I Title IX Prohibited Conduct, even if proven, the school can dismiss the formal complaint regarding that conduct for purposes of Section I of this Policy. However, there is a Section II to their policy regarding sexual misconduct that may still apply.

What Conduct Can Trigger a Georgetown College Student Title IX Investigation?

Conduct that can trigger a formal Title IX complaint and investigation at Georgetown College includes:

  • Stalking and sexual harassment
  • Physical or sexual assault
  • Domestic or dating violence

Title IX investigations can also extend to off-campus behavior, including situations where the conduct impacts the college’s ability to provide an environment free from discrimination or where the alleged perpetrator or victim is participating in a college-sponsored activity or program.

Potential Sanctions

If a student is found responsible, potential sanctions may include:

  • Formal reprimands or written warnings
  • Disciplinary probation
  • Loss of campus housing privileges
  • Suspension from the college
  • Permanent expulsion

Georgetown College may retain disciplinary records for years after a case concludes. In some circumstances, those records can affect transfer opportunities, graduate school admissions, scholarship eligibility, and professional licensing applications.

Our Georgetown College student defense attorneys can help you navigate every stage of this process and work toward the best possible outcome.

Can I Have an Attorney Help Me Through This Process?

Yes. Having experienced legal counsel involved from the earliest stages of a Title IX investigation can be extremely beneficial.

A Georgetown College student defense lawyer may be able to:

  • Advise you before interviews or meetings with investigators
  • Review notices, allegations, and investigative reports
  • Identify factual inconsistencies and procedural concerns
  • Help prepare written statements and responses
  • Assist with witness preparation and strategy
  • Provide guidance throughout hearings and appeals

Having an advocate who understands these proceedings and is prepared to hold the institution to its own procedures can be one of the strongest protections available to students.
